Terms of use

These terms govern JamaicaMD.com, a public directory of healthcare providers and clinics in Jamaica, operated by HealthTech, Inc. (“HealthTech”, “we”, “us”). Booking, messaging, and clinical features are governed by the terms on app.jamaicamd.com/terms when you create an account. By using this site you agree to these terms.

1. What this site is — and is not

JamaicaMD.com helps the public find professional healthcare listings. We are a technology and directory publisher. We do not provide medical care, medical advice, or emergency services. Always verify hours, fees, and suitability directly with the practice. In an emergency, contact local emergency services.

2. Directory listings

Listings may include a professional’s name, specialty, practice location, and a practice contact number. They may be supplied by the practice, compiled from publicly available professional information, or both. A person may appear in the directory before they create a JamaicaMD account.

Listings are provided for information only. We do not warrant that names, addresses, specialties, or phone numbers are complete, current, or correctly classified as office versus personal. If something is wrong, use the process in section 4.

We aim to show professional contact details only. Personal, mobile, home, private, or unlisted numbers, and numbers used for identity verification, are not intended for public display. If one appears, it should be treated as an error and reported for removal.

3. Claimed listings and provider warranties

If you claim or edit a listing, you warrant that you are authorised to do so, that information you submit is accurate, and that any phone number you provide is a professional practice number you are allowed to publish — not a personal or verification-only number. You grant us a licence to display that information on JamaicaMD properties.

4. Corrections and personal-data takedown

The listed professional (or an authorised practice representative) may request that we:

  • Remove a personal or mobile number from public pages
  • Correct inaccurate listing information
  • Show a different practice number, or no number
  • Review a request to hide or remove a listing

Email [email protected] or use our listing data request. We aim to suppress personal or mobile numbers from public pages within two business days of a valid request. Search engines and third-party caches may take longer to update; we will update our pages and sitemaps.

We may verify that the requester is the listed person or is authorised. We may refuse abusive, fraudulent, or competitive takedown requests, but we will not keep a reported personal number on a public page while we check identity.

5. Acceptable use

You may not:

  • Scrape, harvest, crawl, or bulk-copy listings, phone numbers, emails, or personal data
  • Resell, republish, or commercially exploit the directory database
  • Use listing contact details for spam, telemarketing, harassment, or identity fraud
  • Use a number from a listing for identity verification, banking, SIM registration, or similar private purposes
  • Misrepresent a listing, impersonate a practice, or submit false claim information
  • Interfere with the site, probe it for vulnerabilities, or attempt unauthorised access
  • Upload malware or content that is unlawful, defamatory, or infringes others’ rights
  • Use the directory for any unlawful purpose

We may suspend access, remove content, and report abuse. Unauthorised use of listing data may violate data-protection, anti-spam, and computer-misuse laws.

6. Licence to use the site

We grant you a limited, revocable, non-exclusive, non-transferable licence to access the site for personal, non-commercial use (or to manage a listing you are authorised to claim). We may change, suspend, or discontinue any part of the site at any time.

7. Intellectual property

The JamaicaMD name, site design, and compilation of the directory are owned by HealthTech or its licensors. Individual practice names remain those of the practices.

8. Disclaimers

The site and listings are provided “as is”. To the fullest extent permitted by law, we disclaim warranties of accuracy, fitness for a particular purpose, and non-infringement. Appearance in the directory is not a recommendation, credential check, or guarantee of care.

9. Limitation of liability

To the fullest extent permitted by law, HealthTech and JamaicaMD are not liable for (a) medical outcomes or provider conduct, (b) outdated or misclassified listing information, including a phone number that a source treated as a practice number, (c) third-party sites or search-engine copies of our pages, or (d) indirect, incidental, special, or consequential damages. Our aggregate liability arising from this site is limited to USD $100 or the amount you paid us in the twelve months before the claim, whichever is greater. Nothing in these terms limits liability that cannot be limited under applicable law, including for fraud or death or personal injury caused by negligence where such a limit is prohibited.

10. Indemnity

If you claim a listing or submit information, you will indemnify HealthTech against claims arising from that information being inaccurate or from your publishing a number you were not entitled to make public, except to the extent caused by our wilful misconduct.

11. Privacy and no sale of data

Our Privacy Policy explains how listing and visitor data is handled, including suppression of personal numbers. We do not sell personal information. The Privacy Policy is part of these terms.

Electronic notices: you agree that we may send service notices by email or by posting on the site. Links to third-party sites are not under our control.

12. General

You may not assign these terms without our consent. We may assign them in connection with a reorganisation or sale of the service. If a provision is unenforceable, the rest remains in effect. A failure to enforce a provision is not a waiver. These terms and the Privacy Policy are the entire agreement for use of this site. We are not liable for delays caused by events beyond our reasonable control.

13. Governing law

These terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law rules, except that: (a) if you are a data subject in Jamaica, the Jamaica Data Protection Act applies to our processing of your personal data; and (b) mandatory consumer or data-protection rights in your country of residence are not waived. Courts in Broward County, Florida, have exclusive jurisdiction over disputes arising from these terms, except where a data-protection authority or court of competent jurisdiction must hear the matter.

14. Changes

We may update these terms by posting a new version on this page. Continued use after the updated date constitutes acceptance, except where applicable law requires additional notice.
